In Hopkinsville, consent is the new power constraint
North Campbell's 15MW conversion gets grandfathered; its 50MW expansion must buy a thousand feet of setback.
Sherry Byerline, who lives in Pembroke, told Hopkinsville's city council she can already hear industrial machinery operating several miles from her home, the source being a 15MW Bitcoin mine that has run at the Holland Substation for about three years; the hearing, however, was about a different machine, the 50MW data center North Campbell Land Co. wants to build somewhere else in the city under a zoning code that does not yet have a category for it.
North Campbell is pursuing the conversion and the expansion at the same time: the existing cryptomine, roughly 22 modular computing units using surplus capacity at Hopkinsville Electric System's Holland Substation, is being repurposed for AI and high-performance computing, while the second facility would be 50MW but has no disclosed location, footprint, construction cost, development schedule, or named tenants for the AI or HPC space.
The mine already carries one feature that could help its case — a flexible-load program that lets the Tennessee Valley Authority reduce or halt its power draw when the system is under peak demand — and that program is part of the pitch Hopkinsville Electric System's general manager, Jeff Hurd, makes to the council. The utility uses the operation's revenue, Hurd said, to offset costs that would otherwise fall on its roughly 13,000 customers, and he has also said TVA can supply the extra power without affecting existing customers and that a new substation could be ready in six to twelve months.
The project has a friend on the grid side, but no zoning category, because Hopkinsville does not classify data centers as a separate land use. A working draft would establish categories: facilities using less than 75MW and occupying less than 50,000 square feet would be 'large-scale data centers' subject to a 1,000-foot setback from residential, public, and quasi-public properties; facilities consuming at least 75MW or occupying 50,000 square feet or more would be 'hyperscale' and prohibited. The 50MW project is under the megawatt threshold, but unless its footprint stays under 50,000 square feet, it would fall into the banned bucket.
The existing mine, by contrast, would likely be grandfathered, giving North Campbell a valuable option: the 15MW conversion could proceed without the setback because the cryptomine is a legal nonconforming use. The 50MW expansion is where the new rules would bite.
Residents made clear what they expect from the newer, bigger project: Becca Hostilo asked the council to require closed-loop cooling, protect the Little River and Lake Barkley, and consider capping the number of data centers in the city. North Campbell's representatives said the proposed facility would use a closed-loop system that recirculates water, and Thomas Masiero, a company representative, said the existing mine has generated no noise or water complaints. Those assurances cover a building whose site plan, water needs, and generator configuration have not been disclosed.
The economics of the 50MW build are also changing underfoot: TVA removed data centers from its manufacturing rate class in August and imposed a $1.5 million-per-megawatt capacity charge on new connections, as PWD reported, which for a 50MW new connection is $75 million before a single server is installed. The conversion of the existing mine inherits a connection that predates the tariff and so avoids that charge; the expansion, if it comes as a new connection, does not.
Attorneys for HES and North Campbell argued over the proposed setback requirement, though the coverage does not record the specifics. The fight in Hopkinsville is about where data centers can go and at what scale — the same question settling over every small city with a substation and surplus power, and the reason community consent now constrains construction.
Consent and construction capacity are now the scarce power rights, and the Sphere 3D proposal that surfaced in Kentucky this week — a crypto miner offering to fund a substation for a 50MW data center before it has a tenant — is another bid for those rights. The Hopkinsville hearing shows what the winning bid looks like: a closed-loop cooling system, a flexible-load agreement, a grandfathered 15MW machine hall, and land that sits a thousand feet from the nearest house.
The council's vote on the working draft will price that distance: if the 1,000-foot setback holds, buildable land within reach of Hopkinsville's substations will carry a premium, and North Campbell's grandfathered conversion becomes the low-cost route to AI capacity. The 50MW expansion is the first test of the new math; the conversion is the hedge, and the rest of the industry will be watching which one Hopkinsville prices.
